make your way towards santa clara. back to the desk. >> thank you. tara. happening today -- the group justice for andy lopez is organizing a march for the 13- year-old. last week he was shot and killed by a sonoma county sheriff's deputy. alex savidge is in santa rosa where today's march is expected to bring in hundreds of people. good morning, alex. >> reporter: good morning. a lot of people expected to take over the streets of downtown santa rosa later on today. they are outraged over the deadly shooting of that 13-year- old boy, andy lopez. it happened one week ago here in the spot where we're standing. this field has turned into a memorial for the young man. this is where a sonoma county sheriff avenue deputy opened fire on the teenager holding a replica ak-47 that turned out to be a bb gun. today's protests will start at noon here in santa rosa. people will converge on the sonoma county sheriff's office

on ventura avenue. now, county offices and city hall will be closing at lunchtime in response to what is expected to be a laurk- -- large-scale demonstration. the department says lopez was holding an air soft gun that resembled an assault rifle and failed to put it down. yesterday, they released the identity of the deputy. he's 48-year-old erick gelhaus. a 24-year veteran of the department. according to his linked-in profile he's an iraq war veteran. one organizer believes the deputy didn't have to shoot. >> i think the community is tired of being somewhat persecuted. always feeling they are suspicious in some way. >> reporter: now, posts on the facebook page for and yip lopez are enkuging students to leave class beginning at 10:00 a.m. to take part in the march. but the santa rosa superintendent is encouraging kids to stay in class.

he doesn't want them to leave class to take part in today's event. in the meantime, there are a number of groups from beyond santa rosa getting involved. i want to put up a live picture if we can from downtown oakland. this is a live shot from gankg obau wa -- from frank ogawa plaza. this is where people will be picked up to santa rosa to take part in the march that will be happening today. it's a march that begins hat around noon. it begins in two different spots and two different groups of people are expected to join up and converge, again, for a large rally in front of the sonoma county sheriff's department offices in downtown santa rosa. live in santa rosa, alex savidge, ktvu channel 2 news. >> thank you, alex. 7:06. now this morning, an arson investigator was called to the scene of a house fire in oakland. this fire began after 2:00 a.m. on lynnden street. firefighters got the fire under control in about ten minutes.

one person was displaced and no injuries were reported. 7:06. also new this morning, police in burlingame want your help trying to find a missing man. 79-year-old scottie morris last scene, monday afternoon leaving his house on ralston avenue. his wife think hes went for a week several blocks from hole. he was wearing a white sweatshirt and black sweatpants. there are few other details right now. but if you have any information, call burlingame police. another protest being planned by the people who camped out all night at a san francisco city park. ktvu's christien kafton is live at san francisco's city hall where the protesters will meet again today later today. christien what, are they upset about? >> reporter: that's right. protesters set to show up here at city hall, 12:30. they are upset about a new proposal about closing the city parks. we were at dolores park at 4:30 a.m. we have video to show you as

the protest came to an end at about 5:00 this morning. protesters out there to raise awareness about a new plan pitched by scott wiener. that plan to close city parks between midnight and 5:00 a.m. now, the two dozen or so campers out there overnight said the plan would criminalize being poor. superwiener says closing the -- supervisor says closing the park would fight illegal dumping and vandalism and the chief of police said that -- the protester said that plan would criminalize being poor. >> both vandalism and dumping as well as sleeping in the parks are already illegal. what this would do is give the police and rangers extra agency to be in the parks. >> reporter: san francisco's police chief did weigh in saying he supports the plan but he also says he wouldn't abuse any new powers. >> i know there's been some issue made that this would be used for a clearing of the park and we absolutely don't have the resources or the intention

that that's how it would be used. >> reporter: now, again, protesters saying they will be here on the steps of city hall at 12:30. they say they will be going into today's supervisors' meeting to let the board know how they feel about the new proposal. they say they are hoping to sway a couple of the supervisors who they feel are on the fence about the issue. we'll are have continue coverage for you on this throughout the day. for now we're live in san francisco, christien kafton, ktvu channel 2 news. >> thank you, christien. happening right now -- the woman in charge of the office that created healthcare.gov testifies this morning at a congressional hearing. maryland taviner is the administrator for the centers for medicare and medicaid services or cms. this is a live picture out of the house ways and means committee hearing room. they brought in contractors to help build the website. you may recall in testimony last, with the contractors said they warned cms of the risk involved with launching the

website on october 1st. meanwhile, there are reports this morning that millions of americans who buy their health insurance individually are getting their policies canceled and that the obama administration has known about that for three years. according to nbc news up to 14 million people who buy their health insurance individually will receive a cancellation letter in the next year because the current policies don't meet the standards laid out by the new law. the white house told nbc that people whose policies will be canceled will in most cases be automatically shifted to plans with better protections. and peter lee, the director of california's health insurance exchange, says he will not reveal how many californians have enrolled in the covered healthcare plan until mid-november. but he says once the figures are posted, they will be very detailed, broken down by city,

age of enrollees and which kind of plans they've selected. 7:10. the defensive coordinate for the oakland raiders has apologized for the obscene gesture he made on the field in sunday's game against the steelers. now, he made that gesture twice while protesting a referee's call in the third quarter of the raiders' 21-18 win over the steelers. there it is. he says he was in the heat of the moment. he now regrets what he did. well, the national football league is reportedly considering a hefty fine. it could be tens of thousands of dollars. a meeting will be held about the money problems of the moraga orinda fire district. according to a financial audit, the district failed to reserve more than $2 million in general fund reserves. the mine was supposed to be use -- money was supposed to be used to repay debt. earlier, officials decided they were gonna cut daily staffing from 19 down to 17. that's expected to save about

in that complex. also tonight, the berkeley city council will make a big decision about an apartment building that bursts into flames last march. former tenants have filed an appeal. they say the owner disconnected fire alarms before the fire and improperly installed a water heater. firefighters say the fire at the building on dwight way was an accident that started in a water heater closet. happening now, a senate hearing looking into stand-your- ground laws. this is a live picture of the hearing. trayvon martin's mother is testifying this morning. neighborhood watch volunteer, george zimmerman, was found not guilty in the 2012 killing of 17-year-old trayvon martin who was unarmed. trayvon martin's mother says laws like stand-your-ground law can be abused. at least 22 states have laws that allow people facing a

serious physical threat to defend themself. a former child care worker is due back in court. he's scheduled to enter a plea and is accused of abusing several children under his supervision while working as a ymca child care worker in morgan hill. prosecutors say all of his alleged victims were under the age of 13. one girl was just 3 years old. there's concern about the amount of chemicals that end up in the san francisco bay. according to the san francisco chronicle, the chemicals are manly used in homes and businesses and if they are not checked, it could hurt the aquatic live out there. experts say one chemical found a lot is fibronil, used to kill fleas on pets frequently.

accused of running over and killing two people. >> yeah, marjorie reitzell is set to appear in court. she's accused of killing a couple in menlo park last week. reitzell's brother says she doesn't remember a thing. now, she's accused of driving drunk and hitting and killing the couple as they walked their dog last thursday. the district attorney says reitzell was driving with a blood alcohol level well above the legal limit of .08. her brother is offering his condolences to the family. but says that ever since their mother died a year ago, his sister has been on a downward spiral. >> she had an emotional breakdown, you know what i mean? she's not medically, physically healthy. she has a lot of things going on in her mind. but for something like this to happen, i think it's gonna take a toll on her. >> he says he visited her. she does not remember the accident. he also says that she suffers from other mental health conditions. now, court records show that

reitzell has had dozens of brushes with the law. dating back to 1984. we'll talk about some of that history in our next hour of "mornings on 2." dave? >> pam, thank you. meantime, the suspect wounded in sunday's police shooting in san francisco's marina district is due to be formally charged today. police say they were forced to open fire on the man after he allegedly beat and shot another person at chestnut and pierce streets. ktvu has learned the name of the man wounded in that shooting is nabarez, junior. he's listed in critical condition at san francisco general hospital. kids who live at an apartment complex in free montare being barred in playing in a certain area. that policy has sparked a federal lawsuit. ktvu's janine de la vega joins us live from fremont now to explain all of this. good morning, janine. >> reporter: good morning, tori. in the past 30 minutes, i talked to a couple of the

residents here. they say they got a letter telling them their kids were not allowed to play in any of the grass throughout the complex. well, federal officials say that's way too restrictive. the u.s. department of justice has filed a lawsuit against the owners and operators of the woodland garden apartments, alleging they discriminated against families with children because they prohibited kids from playing in the common grassy areas of the complex. federal officials say family with kids should have the same ability as other tenants to enjoy themselves. they say the complex is vite rye -- violating the fair housing act. they decided to sue after reviewing complaints from five families with children who live there. we spoke to a neighbor who said he would be upset if his complex had that policy. >> sounds very strange. i think all of the apartments have been kid-friendly. our kids play outside all of the time. i don't know where this is coming from. a little hard to believe.

>> reporter: the staff there was reportedly concerned about the landscape being ruined at woodland. the lawsuit seeks a court order prohibiting woodland garden apartments from discriminating in the future, a civil penalty as well as monetary damages for the families. i've put in a call to the manager here at woodland to respond to the lawsuit. but they have not reached back out to us so far yet. reporting live in fremont, janine de la vega, ktvu channel 2 news. >> thank you. 7:35. a san francisco jury has awarded $3.7 million to 15 firefighters who sued claiming age discrimination. jurors found the san francisco fire department guilty of tampering with promotions exams. current and former firefighters claim a 2008 lieutenant's exam was doctored after the initial scoring process and they were denied promotion. the majority of the jury agreed. >> kind of validates everything that we always thought and this

is the group that said, hey, wait a minute. this isn't right. >> the city attorney's office says it disagrees with the verdict and maintains there's no age discrimination within the fire department. administrators have not said how the ruling would affect future exams. 7:35. tesla says the latest fire of a model s sedan, once again, shows how the car protects the driver in a crash. a mexican newspaper posted this video here of a tesla sedan after it crashed through a concrete wall and ran into a tree. the driver was able to get out before that car burst into flames. now, the company adds the driver is already buying another model s. this is the second time this month a model s was involved in a fiery crash. the earlier crash happened near seattle. ten people in hayward now looking for a new place to live after an out-of-control car crashed into an apartment building. now, this happened yesterday afternoon at jackson and grand.

people said they heard screeching tires before a mustang crashed through a bedroom call. luckily, in one was hurt. police -- no one was hurt. police believe the car was speeding. 7:36. a safety meeting is planned tonight in response to home burglaries in the mountains of southern santa clara county. one victim said armed men stole thousands of dollars in electronics, jewelry and a gun from his home on brush road and highway 17 on october 11th. a similar case happened back on september 27th at a home on stage coach road in los gatos. sheriff's deputies will be at the meeting at 7:00 at the redwood estates pavilion in los gatos. more than 120 new bike racks have been added to the north berkeley b.a.r.t. station. b.a.r.t. says more racks will be installed at the lake merritt station in oakland in the next two weeks. b.a.r.t. saysly -- b.a.r.t. police say the racks are more secure than poles.

yesterday, officers handed out information about securing locks. they recommend writing down your serial number. the price tag to build a new arena for the warriors in san francisco keeps going up. the san francisco chronicle says the cost to rehab the old and aging piers where the marina would be built would be as much as $170 million, about 70 million more than first thought. the team is also facing a shrinking time frame to get the project approved and built it in time for the nba season. the warriors, by the way, open their season tomorrow in oakland. well, the boston red sox are now just one victory away from another world series championship. >> that's down into the corner. it is a fair ball.

maze. metering lights are on. give yourself an extra 20 minutes to get into san francisco. back to the desk. the group justice for andy lopez is organizing another march for the 13-year-olds. last week he was shot and killed by a sheriff's deputy. alex savidge is in santa rosa where today's march is expected to bring in hundreds of people. >> reporter: good morning. as many as 1500 people could take over the streets of downtown santa rosa later on today. they are outraged over the deadly shooting of 13-year-old andy lopez. it happened one week ago right here in this spot where we're standing this morning where a large memorial has now been set up here by friends, neighbors and family members. this is where a sonoma county sheriff's deputy opened fire on the teenager who was holding a replica ak-47 that turned out to be a bb gun. today's protest will start at about noon. the people will meet at two locations at the old courthouse square and at santa rosa junior college and then those two

groups will converge on the sheriff's department offices on ventura avenue. in response to this large demonstration county offices, city hall and the courthouse will all be closing at lunchtime. lopez was shot seven times by that sheriff's deputy. the department says the teenager was holding an air soft gun that resembled an assault rifle and failed to put the weapon down. yesterday the sheriff's department did release the identity of the deputy who was involved. 48-year-old erick gelhaus is a 24-year veteran of the department. according to his linked-in profile, he's an iraq war veteran. one of the organizers of today's march say the deputy was too quick to open fire and says lopez's death has galvanized this community. >> they are outraged, sad, still fearful, of course. but i think they've gotten to the point where they feel they've had enough and are ready to speak out more. >> reporter: a post on the

justice for andy lopez facebook page is encouraging students here in santa rosa to leave class starting at 10:00 this morning, so they can take part in the march. but santa rosa's superintendent is encouraging all students to stay in school today. there are a number of groups involved in today's march from outside of this area as well. that includes occupy oakland organizers who are planning to bus people from frank ogawa plaza up here to santa rosa to take part in today's event. now, santa rosa police are investigating this deputy- involved shooting along with the fbi also conducting their own investigation. lopez's father has told ktvu that he believes the deputy involved here should face criminal charges. live in santa rosa, alex savidge, ktvu channel 2 news. >> thank you. new this morning an arson investigator was called to the scene of a house fire in oakland. it began after 2:00 a.m. on lynnden street. firefighters responded to reports of smoke coming to the

building. they got the fire under control in about ten minutes. one person was displaced. no injuries were reported. police in burlingame, they want your help to help find a missing man. 79-year-old scottie morris last seen, monday afternoon leaving his home on ralston avenue. his wife says she think eshe went for a walk on burlingame avenue several blocks from home. he was wearing a white sweatshirt and black sweatpants. right now, there's no other information about how he disappeared. if you have any information, call burlingame police. a group of campers who spent the night out in san francisco's dolores park protesting a new plan to close city parks through the night, well, they've left that area. but ktvu's christien kafton says the protests aren't over yet. you are live at city hall. the protesters will meet again later. what's going on, christien? >> reporter: yeah, that's exactly right. protests planned here at city hall at 12:30. we were at dolores park at

12:30 this morning as the protest was ecbreaking you. we have video -- was breaking up. we have video of it. this was an overnight protests. they were angered over scott wiener, his plan to close the city parks between midnight and 5:00 a.m. now, there were about two dozen campers who stayed the night there. they say the plan would eventually criminalize being poor. they said it would be unfair to homeless people who have nowhere else to go. supervisor wiener says closing the parks would give the police another tool to fight the quality of life crime like illegal dumps and vandalism. right now, have an enorm out amount of vandalism and dumping that happens in the park. the cost -- it cost the parks department more than a million dollars a year and happens in the middle of the night almost excluesively. >> both vandalism and dumping are already illegal. what this would do is really give the police and rangers

extra agency to be in the parks. >> reporter: protesters told me this morning they would be ending their protest at 5:00 a.m. which is the time that wiener's proposed ban would end. they will go home, catch some sleep, and come back to show up for the 12:30 rally and plan to go into the board of is ups' meeting -- supervisors ago meeting. they -- supervisors' meeting. they are hoping to sway some who are on the fence about this. christien kafton, ktvu channel 2 news. >> thank you. there are reports that millions of americans to buy their health insurance individualley are getting -- individually are getting their policies cancelled and the obama administration has known for about three years this would happen. according to nbc news, up 14 million people to buy their health insurance individually will receive a cancellation letter in the next year because their current policies don't meet the standards laid out by

now he regrets what he did. the nfl reportedly is considering a very hefty fine. it could be tens of thousands of dollars. a meeting will be held today to address the money problems of the moraga orinda fire district. according to an audit, the district failed to reserve more than $2 million in general fudz. that money was supposed to be used to repay the district's debt. earlier this month, officials decided to cut daily staffing from 19 down to 17. that's expected to save about $550,000 this fiscal year. jury deliberations start today in a marin county court in the trial of 18-year-old max wade. he's accused of stealing the luxury car of a celebrity chef and he's also accused of attempted murder. yesterday, celebrity chef guy fieri testified he never gave wade permission to take the car. wade is accused of stealing

people have been knocked off their feet. i'm not kidding. this is in brussels. in england, a teenager was killed while paying on the coast. a 17-year-old girl was crushed by a big tree. one family escaped their house after a tree came down on it. >> i fought my way out through the front door. the tree was blocking our entrance. >> now, 120-mile-an-hour winds reported in denmark and there have been a lot of injuries at the office of britain's deputy prime minister, a construction crane snapped and fell on the roof of the building. power has been restored to many homes in the u.k. but about 61,000 still have no electricity. back here hat home, there's a -- at hole, there is a big -- home, there is a meeting for those burned out of the terrace apartments in redwood city. the meeting is at 7:00 p.m. at the fair oaks community center on middlefield road. they will try to help residents get back on their feet.

this comes two weeks after the huge fire damaged all of the apartments in the complex. in berkeley, the city council will make a decision about an apartment building that caught fire there last march. former tentants filed an appeal. they say the owner disconnected fire alarms before the fire and improperly installed a water heater. firefighters say the fire at the building on dwight way has an accident that began in a water heater closet. happening now, the woman in charge of the office that created healthcare.gov is testifying before congress. as kyla campbell reports from our washington, d.c. newsroom, we did hear an apology last hour. >> reporter: tori, maryland tavner is the administration for cms. cms was responsible for creating healthcare.gov and tavner says it's falling short of expectations. >> i want to apologize to you

that the website has not worked as well as it should. >> reporter: the committee chairman asked her how many people have successfully enrolled in health insurance programs this month. she said that number will not be released until mid-november. she said she expects the numbers to be low at first but to grow over the six-month enrollment period. but the republican chairman said people across the country are far from satisfied with healthcare.gov and he says people in his home state of michigan are nooning -- are running into trouble. >> i think i would have a meeting in my office and have all of them sit in who have successfully enrolled in the plan. >> reporter: and this is a live look at the hearing. so far, republicans have not asked her why cms went forward with the launch despite being washed of the risks -- warned of the risks by website contractors. today's hearing is giving us a taste of what we can -- what we can expect tomorrow. that's when kathleen sebelius will be testifying for the

running scheme. and now another nfl player is involved in this accident. hernandez pleaded not guilty to murder and weapons charges in the shooting death of odin lloyd. now, sports illustrated reports miami dolphins center mike pouncey was subpoenaed on sunday. that subpoena is reportedly related to the investigation into hernandez and his possible involvement in gun trafficking. pouncey is a close friend of hernandez. police view him as a witness. but he's not been charged with a crime. a new digital billboard is headed to daly city. the sign will be put up at the northeast corner of the shopping center and visible to commuters on interstate 280. the sign will be donated by the westlake park community center. the vice mayor says it's a big win for the sit since it allows the government and nonprofits to display message, the billboard is equipped with a brightness dimmer and will be turned off every nighted a mit

pacific. the good news has been up in the sierra. we'll take all of the snow we can. maybe 2, 6 inches. some of the higher elevations are checking in with a foot and a half, two feet. far less than that. as you get towards 5500 and 6,000 feet. 36 up in tahoe. on the milder/warmer side. 36 in ukiah under mostly clear skies. they do have patchy low clouds up there. we do see a lot of low clouds hoeferrer us. but they will clear out. there's definitely clearing to the north. you can see kind of another band moving in near reno, carson city. most of this is starting to push off toward the northeast. that system will move into the third quarters, giving the rockies a lot of snow. 40s for us 50s. the farther north you go, the colder. 30s, a few 20s into lake

-- highway -- near highway 87 just south of highway 92, sorry, 280, three-car crash injury accident. an ambulance is on the way. that's definitely causing some backups as well. finally a look at the bay bridge toll plaza, you can see it really has hat -- has not changed much since this morning. a heavy gridlock past the maze. give yourself an extra 20 minutes. back to the desk. a horrible case to tell you about, a couple hit and killed while walking their dog. pam cook is in the studio with new insight we're getting into this. >> a mentally and emotionally troubled woman, that's how marjorie reitzell is described by her brother. she's accused of driving drunk and hitting and killing balbir singh and his wife kamal while they were out walking their dog in menlo park. prosecutors say her blood alcohol level was .15. and she was still on probation

from a misdemeanor drunk driving offense last year. she went through a substance abuse program and was allowed to drive again but her brother says she's not mentally or physically healthy. >> my sister had a meltdown when my mother passed away last year. she had been on a downward spiral ever since. >> prosecutors tell us that they have interviewed marjorie reitzell. they won't say what she's said. say say -- they say her memory is foggy because of the accident and her intoxication. her brother tells us she does not remember the accident and insists that she did not hit anyone with her car. now, if convicted, marnlry reitzell -- margery reitzell faces up to 15 years in prison. she's a -- she will be arraigned on those charges in court today. dave? >> all right, pam. the suspect wounded in sunday's police shooting in the marina district is expected to be formally charged today. police say they were forced to shoot and open fire on the man after he allegedly beat and

shot another person at chestnut and pierce streets. ktvu has learned the name of the man wounded is nabarez nobo junior. he's listed in critical condition. well, a bay area apartment complex has caught the eye of the department of justice and they have filed a lawsuit. it has to to with letting kids play on that -- it has to do with letting kids play on the property. janine de la vega is joining us live from fremont. it's sounding like the apartment complex, they may have changed practices out there. >> reporter: people who livg here at the woodland guard -- living here at the woodland garden apartments were told their children were not allowed to play on the grass. i just spoke to a mom who said the policy has been changed and the kids can play on the graus but only if the -- grass but only if the parents are

present. but a lawsuit has been filed alleging they discriminated against families with children. the suit says they prohibited kids from playing in the common grassy areas of the complex which is in a violation of the fair housing act. the lawsuit arose because five with children filed complaints with housing and urban development. we spoke to a neighbor who said he would be upset if his children were not allowed to play. >> i would like to hear more about what's going on and how they are taking up this case. but if they are telling they it's not fair, i think they are pretty right there. >> reporter: several reviews stated management of the complex was threatening eviction 23 kids continued to play in the grass and instead suggested the kids be taken to the park.

i've called the complex and i've knocked on the manager's door. so far nobody has responded. reporting live from fremont, janine de la vega, ktvu channel 2 news. 8:35. a san francisco jury has awarded $3.7 million to 15 firefighters who sued claiming age discrimination. jurors found the san francisco fire department guilty of tampering with promotions exams. current and former firefighters claim a 2008 lieutenant's exam was doctored after the initial scoring process and they were denied promotions. the city attorney's office maintains there is no such discrimination. 8:36. b.a.r.t.'s two biggest unions due to vote this friday on a new four-year contract. union members will decide if they want to ratify the tentative agreement that ended the latest b.a.r.t. strike a week ago. yesterday, union leaders passed

out copies of the agreements to workers. >> of course, everything is not gonna be perfect. but as far as initially read over, as far as what i see now, it seems good. i'm gonna vote yes. >> it's a decent contract we can live with. considering the lock fight we've been in, i think we'll -- long fight we've been in, i think we'll come out victorious. >> the results are expected late friday night or early saturday morning and then b.a.r.t. eight board will decide if they want to ratify the contract. both sides are expected to approve the deal. b.a.r.t. will be testing new seats. b.a.r.t. riders you can try out three different train car seats. it will be the fleet of the future. the testing will take place at 3:00 this afternoon at the west dublin pleasanton b.a.r.t. station. this is part of a nine-station survey of these new seats where you riders actually pick your favorites. tesla says the driver of a

model s that crashed and burned in mexico has already ordered another one of the electric sedans. the mexican newspaper posted this video of the tesla sedan after a crash through a concrete wall -- after it crashed through a concrete wall and the driver was able to get out before it burst into flames. it's the second time a model s was involved in a fiery crash this month. the earlier crash happened in washington state. >> ten people are looking -- [inaudible] >> police say it appears the car was speeding in this incident. a safety meeting planned tonight in southern santa clara county dealing with home burglaries in the mountain areas. one victim told the los gatos patch armed men stole thousands of dollars in electronics,

jewelry and a gun from his house on brush road and highway 17 on october 11th. a similar case happened on september 27th at a home on stage coach road in los gatos. sheriff's deputies will be at the meeting at 7:00 at the redwood states pavilion in los gatos. a funeral home is closing its doors. and the new owner, marissa mayor. the 114-year-old mortuary is at the corner of middlefield and addison. it will close its doors for good, believe it or not, on halloween. now, ma ris cau mayor -- marissa mayer has not said why she's buying it. we don't know how much she paid the site is d for residential purposes. her current home sits on .03 acres. the funeral home is on a 1.6- acre land. the cost to build a new

arena for the warriors in san francisco keeps going up. according to the san francisco chronicle, the cost to rehabilitate the aging piers where the new arena would be built would cost as much as $170 million. that's about 70 million more than originally thought and they would just be north of at&t park. now, the team is also facing a sh inking time frame to get the arena project approved and built in time for the 2017 nba season when the lease runs out. the warriors open up their season tomorrow in oakland. well. the -- the boston red sox are one win away from a world series championship. >> that is a fair ball. >> yeah, the red sox beat the cardinals 3-1 in st. louis last night. that gave the red sox a 3-2 lead in the series. the world series now heads back to boston's fenway park for

hitting and killing a couple in menlo park last week is due to appear in court today. the district attorney says marjorie reitzell had a blood alcohol level that was well above the legal limit. her brother says she's been on a downward mental spiral since their mother died a year ago. and in santa rosa, the group, justice for andy low pest, they -- lopez are planning another big march today in memory of the 13-year- old. last week, he was shot and killed by a sonoma county sheriff's deputy. alex savidge is back now in santa rosa. what's going on out there? >> reporter: well, good morning. they are preparing for a large march that will take place this afternoon. as many as 1500 people could take part and take over the streets of downtown santa rosa. there's a growing sense of acre over the shooting of andy lopez. you can see it here this morning. some people visiting the memorial where he was shot last

week by a sheriff's deputy. the teenager was holding a replica ak-47 that turned out to be a bb gun. today's protest will begin at noon. they will meet at old courthouse square and at santa rosa junior college and they will converge on the sheriff's office at 2:00 this afternoon. there are also a number of other groups involved from outside of the area, including occupy oakland which is planning to bus people from frank ogawa plaza up here to take part in the event. now, lopez was shot seven times by that sheriff's deputy. one week ago today, the department says the teenager was holding an air soft gun that resembled an assault rifle and failed to put the weapon down when deputies showed up. yesterday, the sheriff's department released the identify tie of the deputy who opened fire, erick gelhaus. a 24-year veteran of the

department. according to his linked-in profile, he's an iraq war veteran. those taking part in the march believe the deputy didn't have to shoot. >> it wasn't fair for him and his family. should have done something else, not shoot him seven times. not fair. >> reporter: now, santa rosa police are investigating this deputy-involved shooting and so is the fbi. the sheriff up here in sonoma county says he welcomes the outside investigation by federal investigators. there's a post meantime on the justice for andy lopez facebook page that it is encouraging students to leave class today beginning at about 10:00 this morning to take part in this march. but santa rosa's superintendent at the same time is encouraging students to stay in school. but as we bring you back out here live at the memorial, i was speaking with some of these young people over here. they tell me they plan to take part in the march. i asked them how many other students will be involved as well. they said a lot. we'll have to wait and see. this march begins at noob today

here in -- noon today here in santa rosa. alex savidge, ktvu channel 2 news. >> thank you. 8:48. one year ago today hurricane sandy devastated the northeast coast. it was the second costliest storm on record after hurricane katrina with damage totaling $50 million -- $50 billion. more than 100 people were killed in the storm. many people are still without homes and the rebuilding effort continues. the amount of chemicals making their way into the san francisco bay is raising concern. according to the san francisco chronicle, the chemicals are mainly used in homes and businesses and if unchecked could harm aquatic life. experts say one chemical being found in the highest doses is fiprnal used in insecticides to kill insects in the home and fleas in pets. let's check in with tara right now. muni is having some problems, right?

>> yeah. muni had a couple of delays on the f-line. a non-muni accident. those shuttles were being run. they just posted on twitter, that they've cleared the problem. it's being taken care of. the service is back to normal. right now you can see the congestion we're talking about on 680 southbound from the concord area saul the way down to san ramon still in effect. if behead -- if we head to richmond, you can see it's pretty clear. not too bad near hercules. we have -- we can see the metering lights are on. 6le 0 near walnut creek -- 680 near walnut creek. this has improved slightly. these cars are inching a little bit. it's been bad in the southbound direction due to an earlier accident. so again, think ahead give yourself some extra time.

new this morning, jesse jackson junior erk the former illinois contractor, has reported to a north carolina federal prison. he's starting a two and a half- year prison sentence for misusing campaign funds. jackson's spokeswoman says he reported to a correctional center near raleigh. his wife was also sentenced to a year in prison for filing false tax returns.

now, in a concession to their two school-aged children, the judge allowed the jacksons to stagger their prison sentence. the company that makes siracco's chili sauce is being sued. they are in irwindale. the city says the irwin dale claims there has been complaints from residents about the smell coming from the victory. scott wiener plans to propose a new tax on shoe ari drinks. this would increase the price of sodas and sweet drinks by two cents. though a 12-ounce bottle will cost an additional 24 cents. san francisco supervisors are expected to approve the idea
